Bank of America CEO Brian T. Moynihan’s recent public tirade against consumers hurt by the foreclosure crisis is an attempt to marginalize and demonize homeowners seeking relief from the Bank’s role in the foreclosure crisis, according to Vito Torchia, Jr., managing attorney of Brookstone Law, PC.

According to media reports, in a recent global town hall meeting, the Bank’s CEO said he is “incensed” by public criticism of his company and told the bank’s critics they ought to “think a little… before you start yelling at us.” The company has launched an advertising and public relations campaign designed to influence local and state officials to improve the bank’s battered public image and the event followed the Bank’s announcement of a third-quarter profit of $ 6.2 billion.

“The comments are an outrageous affront to thousands of homeowners who have been hurt by Bank of America’s incredibly poor management and proven lack of due diligence,” stated Vito Torchia, Jr. “The remarks clearly demonstrate Bank of America’s disrespect for homeowners, which they have to endure when trying to fix problems created by the very Bank that is publicly criticizing them.”

Media coverage of the Bank’s lack of due diligence and poor management includes the Bank’s getting an address wrong and foreclosing on the wrong national, making bonding payment demands from someone who wasn’t their customer, and threatening a customer with foreclosure if he didn’t make a payment of $ .00, giving the same account number to two different people, opening credit card accounts for people who don’t ask for them and hindering a federal review of FHA-insured housing loans.

“The new PR campaign blatantly ignores the people Bank of America has hurt the most, those who need the most help compensate now as a result of the foreclosure crisis and it is a strategic decision to marginalize those consumers to help the Bank reduce liability from the foreclosure crisis,” according to Vito Torchia, Jr. “It is clear that homeowners are nothing more to them than a means to more profits, which is why those who do not have expert legal counsel to help them should get help as soon as possible before banks farther marginalize their interests.”

According to media describing, Bank of America was named the country’s second-worst company by Consumerist.com following only BP Plc, the firm blamed for the whipped U.S. offshore oil spill.

“It is not surprising that Bank of America ranked lowest in a recent survey of small business customer satisfaction,” according to Vito Torchia, Jr. “Now they are spending millions of dollars to ignore the consumers they hurt and are acting like victims while announcing profits.”

With only “average” attributing…you are wishing for a 5% rate. Full 30 year mortgages are now terminated 5%, so good luck to that!

Here’s the story in a nutshell. I purchased a condo in 2005 on an ARM. Just out of a divorce, I decided to consolidate some debt with a home equity line of attributed called a 125% loan. Bad move, since I didn’t first refi the ARM. Now, the housing market has slumped, my property value is down, I have negative equity, and I can’t refi. The ARM has gone up and is due to go up again in a couple months. My payment has doubled and I can’t afford it. What will happen if I default on the 1st mortgae but remain current on the second? In other words, what happens to the second mortgage, and how might I be liable even if the payments are current on that loan?

As reported by LATimes.com, the line-up for this year’s Bowl Championship Series (BCS) has fallen into place. The Southeastern Conference (SEC) that has dominated the BCS Championship Bowl for a good part of its 13-year history has racked up three spots in the BCS with its constituent schools of Louisiana State University (LSU), Alabama and Arkansas. The first two, i.e. LSU and Alabama have clinched the top two standings with .9522 and .9519 ratings respectively. SEC members have already clocked seven wins out of the 13 BCS championship games that they have played.

The double-pronged Oklahoma schools of the Big 12, the University of Oklahoma and Oklahoma State troop in next at the third and fourth spots at .9301 and .8568 severally. Boise State Broncos of the MWC bucked their way to the fifth spot at .8027. The rest of the top-ten lot contending for a shot at the 2012 BCS bowl game comprise Wisconsin, Clemson, Stanford, Arkansas and Oregon.

The II big guns of the SEC, LSU and Alabama are both getting their sorties together for their Nov. 5 face-off in Tuscaloosa, with the Oklahoma boys gearing up to have a go at each other on Dec. 3rd.

Similar to last year’s run, the release of this year’s Top 25 BCS Rankings on October 16th has set the ball rolling for the build-up to the BCS Championship bowl. The secondary ticket selling website TicketNest.com is assertively speculating prices of BCS National Championship Bowl ticket to take-off during November and virtually break through the roof by January 9th 2012 when the BCS bowl staked is scheduled to be played. I know someone defaulting on their mortgage loan because they decided it is too much owed for a house that has gone down in value 40%. They also have a second loan for $ 75,000. Is that forgiven too? Are there different rules for second loans? These people have assets. Own another property paid in cash plus money in the bank.

The bank will foreclose on the loan, and they will lose the house. The bank will sell it for whatever they can get for it. If they have assets, the bank can go after them for the difference between what was due and the actual selling price, plus all the court costs and attorney fees, which could be tens of thousands on top of the difference (called a deficiency judgment).
